The CodeMasters Academy name, logo, and all related names, logos, product and service names, designs, and slogans are trademarks of CodeMasters Academy or its affiliates or licensors. All other names, logos, product and service names, designs, and slogans on the Site are the trademarks of their respective owners.

User Content

When you post, upload, share, store, or otherwise provide information, data, text, software, music, sound, photographs, graphics, videos, messages, or other materials on or through the Site ("User Content"), you grant CodeMasters Academy a worldwide, non-exclusive, royalty-free, fully-paid, perpetual, sublicensable, and transferable license to use, copy, reproduce, process, adapt, modify, publish, transmit, display, distribute, and otherwise exploit such User Content for the purpose of providing and improving our Services.

You represent and warrant that you own or have the necessary rights to submit the User Content and that the User Content does not violate any third party's intellectual property rights, privacy rights, personality rights, or other rights.

One Account Per Person

You may not share your account with anyone else. You may not have more than one account, and you may not transfer your account to any other person without our prior written consent.

Account Termination

We reserve the right to suspend or terminate your account and access to the Services, with or without notice, for any or no reason, including but not limited to, violation of these Terms. Upon termination, all licenses granted by CodeMasters Academy will terminate, and you must cease all use of the Services.

4. Courses and Content

Course Access

When you enroll in a course, you are granted a limited, non-exclusive, non-transferable license to access and view the course materials for your personal, non-commercial, educational purposes. You may not share your account with others to provide them with access to the course.

Course Availability

CodeMasters Academy reserves the right to modify, update, or discontinue any course or content at any time. We will make reasonable efforts to provide notice of material changes to courses. In the event we discontinue a course in which you are enrolled, we will provide you with reasonable advance notice and a refund or credit in accordance with our refund policy.

Lifetime Access

For courses advertised with "lifetime access," this means you will have access to the course content for as long as the course is offered on our platform and for as long as CodeMasters Academy exists and maintains the Services. If we must discontinue a course due to legal, technical, or business reasons, we will provide advance notice and, where appropriate, alternative options or compensation.

Updates to Course Content

We may update course content to maintain its relevance and accuracy. While we strive to keep course content current, we do not guarantee that any course or its content will be updated. Once a course is published, we may make only minor updates to that specific version of the course.

No Guarantees

While we strive to provide high-quality educational content, CodeMasters Academy does not guarantee any specific results from using our courses or Services. Success in learning programming or development skills depends on various factors, including your own dedication, background knowledge, and practical application of the material.

5. Purchasing and Payment Terms

Pricing

The prices for courses are listed on the Site in Australian Dollars (AUD) and include applicable taxes, including Goods and Services Tax (GST) for Australian residents. Prices are subject to change, but changes will not affect any courses you have already purchased.

Payment Methods

We accept various payment methods, including credit cards, debit cards, and other payment methods as indicated on the Site. By providing a payment method, you represent that you are authorized to use the designated payment method and authorize us to charge your payment method for all purchases you make.

Authorization and Billing

When you make a purchase, you authorize us to charge the full amount to your payment method. If your payment cannot be completed, we may cancel your order or suspend your access to the course until payment is received.

Promotional Codes and Discounts

THE CONTENT IS PROVIDED FOR GENERAL INFORMATION PURPOSES ONLY AND MAY BECOME OUTDATED OVER TIME.

Learning Outcomes

9. Limitation of Liability

You agree to defend, indemnify, and hold harmless CodeMasters Academy, its affiliates, licensors, and service providers, and its and their respective officers, directors, employees, contractors, agents, licensors, suppliers, successors, and assigns from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to:

11. Term and Termination

These Terms shall remain in full force and effect while you use the Site or Services or maintain an account with CodeMasters Academy.

Termination by You

You may terminate these Terms at any time by ceasing all use of the Site and Services and by closing your account. All provisions of these Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

Termination by Us

Without limiting any other remedies, CodeMasters Academy may, in its sole discretion and without notice or liability, deny access to and use of the Site and Services to any person for any reason or no reason, including without limitation for breach of these Terms. In particular, we may, in our sole discretion and without notice, terminate your account and access to the Site and Services, delete your profile and any content or information that you have posted on the Site and prohibit you from using or accessing the Site and Services for any reason.

Effect of Termination

Upon termination of your account, your right to use the Services will immediately cease. However, all provisions of these Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

If your account is terminated due to your breach of these Terms, you may lose access to any courses you have purchased, and you will not be entitled to a refund unless required by applicable law.

12. Modifications to Terms

CodeMasters Academy reserves the right, at our sole discretion, to change, modify, add, or remove portions of these Terms at any time. If we make material changes to these Terms, we will provide notice through the Site or by other means, such as email. Your continued use of the Site and Services following the posting of revised Terms means that you accept and agree to the changes.

It is your responsibility to check these Terms periodically for changes. If you do not agree to any changes to these Terms, you must discontinue using the Site and Services.

For existing users, material changes to these Terms will be effective 30 days after posting unless otherwise stated. For new users, the changes will be effective immediately upon posting.

13. Governing Law and Dispute Resolution

Governing Law

These Terms and your use of the Site and Services shall be governed by and construed in accordance with the laws of New South Wales, Australia, without giving effect to any choice or conflict of law provision or rule.

Dispute Resolution

If you have any concerns or disputes about the Site or Services, you agree to first try to resolve the dispute informally by contacting CodeMasters Academy. If a dispute cannot be resolved informally, you and CodeMasters Academy agree to resolve any disputes through binding arbitration or in small claims court rather than in a court of general jurisdiction.

Arbitration

Arbitration shall be conducted on a confidential basis pursuant to the Commercial Arbitration Rules of the Australian Centre for International Commercial Arbitration. The arbitration shall be conducted in Sydney, New South Wales, unless you and CodeMasters Academy agree otherwise. Each party will be responsible for paying any filing, administrative, and arbitrator fees in accordance with the rules of the arbitrator.

Class Action Waiver

YOU AND CODEMASTERS ACADEMY AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING.

Opt-Out

You have the right to opt out of the arbitration and class action waiver provisions set forth above by sending written notice of your decision to opt out to the following address: CodeMasters Academy, 33 Waterview St, Carlton NSW 2218, Australia, within 30 days of first accepting these Terms. If you opt out of the arbitration and class action waiver provisions, CodeMasters Academy also will not be bound by them.

Jurisdiction and Venue

Any legal action or proceeding arising out of or relating to these Terms or your use of the Site or Services that is not subject to arbitration shall be brought exclusively in the courts of New South Wales, Australia, and you irrevocably submit to the jurisdiction of such courts in any such action or proceeding.

14. General Provisions

Entire Agreement

These Terms, together with the Privacy Policy, Refund Policy, and any other legal notices or additional terms and conditions or policies published by CodeMasters Academy on the Site, shall constitute the entire agreement between you and CodeMasters Academy concerning the Site and Services.

Waiver

No waiver by CodeMasters Academy of any term or condition set out in these Terms shall be deemed a further or continuing waiver of such term or condition or a waiver of any other term or condition, and any failure of CodeMasters Academy to assert a right or provision under these Terms shall not constitute a waiver of such right or provision.

Severability

If any provision of these Terms is held by a court or other tribunal of competent jurisdiction to be invalid, illegal, or unenforceable for any reason, such provision shall be eliminated or limited to the minimum extent such that the remaining provisions of the Terms will continue in full force and effect.

Assignment

These Terms, and any rights and licenses granted hereunder, may not be transferred or assigned by you without the prior written consent of CodeMasters Academy. CodeMasters Academy may assign these Terms without restriction.

No Third-Party Beneficiaries

These Terms do not and are not intended to confer any rights or remedies upon any person other than you and CodeMasters Academy.

Force Majeure

CodeMasters Academy shall not be liable for any delay or failure to perform resulting from causes outside its reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, riots, civil unrest, embargoes, acts of civil or military authorities, fire, floods, accidents, strikes, shortages of transportation facilities, fuel, energy, labor or materials, or Internet service provider failures or delays.

Feedback

Any feedback, comments, or suggestions you may provide regarding CodeMasters Academy or the Site is entirely voluntary, and we will be free to use such feedback, comments, or suggestions without any obligation to you.

Export Control

You agree to comply with all applicable export and re-export control laws and regulations, including the Export Administration Regulations maintained by the U.S. Department of Commerce and trade and economic sanctions maintained by the Treasury Department's Office of Foreign Assets Control. You represent that you are not located in, under the control of, or a national or resident of any country to which Australia, the United States, or other applicable jurisdiction has embargoed goods or services.
